POPIA vs PAIA: Understanding South Africa's Information Laws

Two Sides of the Same Coin

In South Africa, information management is governed by twin acts: the Protection of Personal Information Act (POPIA) and the Promotion of Access to Information Act (PAIA). While they sound similar and are regulated by the same body (the Information Regulator), they serve fundamentally opposite purposes.

PAIA: The Right to Access Information

Enacted in 2000, PAIA is designed to promote transparency. It gives individuals the right to access records held by public and private bodies. If a person believes a company holds information that they need to exercise or protect any of their rights, they can use PAIA to demand access to that information.

Under PAIA, every private body, including sole proprietors, is required to have a PAIA Manual that explains exactly how someone can request access to the company's records.

POPIA: The Right to Privacy

Enacted much later, POPIA is designed to protect privacy. It regulates how businesses collect, use, store, and destroy personal information. While PAIA says "give people information," POPIA says "protect people's personal information."

How They Work Together

The two laws intersect perfectly when it comes to a data subject's rights. Under POPIA, a person has the right to know what personal data you hold on them. They exercise this right by using the procedures outlined in your company's PAIA Manual.

The Role of the Information Officer

The Information Officer is responsible for compliance with both acts. They must ensure the business protects data (POPIA) while simultaneously ensuring there is a transparent mechanism for people to request records (PAIA).
